Frequently Asked Questions

What is TDS and how does it work?
TDS (Tax Deducted at Source) is a mechanism where the payer deducts tax at the time of making payment to the payee and deposits it with the government. The payee gets credit for TDS when filing their income tax return. Common examples: employer deducting TDS on salary, bank deducting TDS on FD interest.
What is the TDS rate for professional fees in India?
Under Section 194J, TDS on professional services is 10%. For technical services and royalty on films, the rate is 2% (Section 194J(a)). The threshold is ₹30,000 per year. If the payee doesn't provide PAN, TDS is deducted at 20%.
What is the TDS rate for rent payments?
TDS on rent for land, building, and furniture (Section 194I(b)) is 10% if rent exceeds ₹2,40,000 per year. For plant and machinery rent (194I(a)), the rate is 2%. Individuals/HUFs paying rent above ₹50,000/month must deduct 5% TDS under Section 194IB.
What happens if PAN is not provided by the deductee?
Under Section 206AA, if the payee doesn't furnish their PAN, TDS must be deducted at 20% or the applicable TDS rate, whichever is higher. This acts as a strong incentive for payees to provide their PAN.
When must TDS be deposited with the government?
TDS deducted in any month must be deposited by the 7th of the following month. For March deductions, the deadline is April 30. TDS on property purchase (194IA) must be deposited within 30 days from the end of the month of deduction using Form 26QB.
